TERMS AND CONDITIONS

When booking a photo shoot, the CLIENT, representing all persons whom will be photographed, agrees to the following terms and conditions:

General

Shutter View Photography intends to display everything on the website correctly and completely, no rights can be derived from the information placed on this website. Shutter View Photography does not accept any liability for any damage resulting from the use of this site or the use of (image) information provided on this site. Shutter View Photography cannot be held liable for material and / or immaterial damage during a photo session on location or in the studio. The pictures may only be used by the owners, Goran and Nadia Popovic. Visitors can view these photos, but are not allowed to use them in any way. The CLIENT is responsible for communicating Shutter View Photography's terms and conditions to all persons whom will be photographed. By using the services of Shutter View Photography in whatever sense, you automatically agree to these terms and conditions.

The copyright of the photos always lies with the photographer of Shutter View Photography. The customer gives the photographer permission to use the photos taken by the customer for promotional purposes on the internet and in printed matter. The customer receives no reimbursement or refund for this. If the customer indicates that he does not agree with the use of the photos for promotional purposes, there is a surcharge of $150 on the report price. The current report price is calculated on the use of the photos for promotion. It is not permitted to place received digital files on the internet in an operation other than that provided by the photographer. After receiving the digital photo files, the customer has the right to reproduce for his own use. Use of the files for commercial or non-profit companies is strictly not permitted. Shutter View Photography will remove the digital files from the photo shoot from its archive / storage after 3 months.

Photo session

To book an appointment for a photo session, the photographer always sends a confirmation. The appointment is only final once the photographer has sent confirmation. If the customer does not agree with the terms and conditions, he or she will contact the photographer at least one week before the photo shoot takes place. A Cake Smash Photo Shoot, Pregnancy Photo Shoot or Portrait Photo Shoot takes an average of 1.5 hours. A Newborn Photo Shoot takes an average of 2 hours. After the photo session, Shutter View Photography provides a small format gallery of un-edited images for clients to select their favorite images. The edited photos will be placed in an online gallery within 3-6 weeks from the date date the selections have been sent through to Shutter View Photography. Full resolution digital photo files can then be downloaded from this online gallery. For a photo session on location, travel costs of $1 per kilometer are charged for distance more than 15 km from South Morang. If you are dissatisfied with something during a session or do not like something, you must immediately tell the photographer. That gives us the chance to do something else. Complaints about this afterwards are considered unfounded. Recordings and / or taking pictures during the session with your own telephone and / or camera are strictly not permitted.

Photo files

With every photo shoot, the agreed amount of digital JPEG files on High Resolution and without logo or watermark are included in the price. Additional JPEG files can be ordered up to 3 months after the photo shoot at an additional cost. It is not possible to receive the raw files and / or RAW files.

Payment

A deposit of must be made to secure all bookings. The balance should is expected to be paid on the day of the photo session in the studio or on location. Any alternative arrangements must be made in consultation with Shutter View Photography at least 3 days prior to the booking date. Extra photo files or products that are ordered after the photo shoot must be transferred. Products are only delivered once payment has been received. Unless stated otherwise, the prices do not include GST and excluding travel costs.

Gift vouchers and discount coupons

Discount coupons are not valid in combination with promotions / offers. Gift vouchers are only available at SHUTTER VIEW PHOTOGRAPHY and are valid up to and including 1 year after the issue date and cannot be exchanged for cash. Gift vouchers cannot be returned. A gift voucher is not transferable. Gift vouchers are valid for the photo session, value or products for which they are issued, as stated on the gift voucher.

Cancellation conditions

SHUTTER VIEW PHOTOGRAPHY shall try to accommodate changes of shoot date when requested by the Client more than six (6) calendar days before the photo shoot date. Deposits are non-refundable. SHUTTER VIEW PHOTOGRAPHY does not guarantee to accommodate any change requests from Client within 6 days from shoot date. If the Client chooses to cancel the photo shoot, the Client forfeits the booking deposit fee.

If SHUTTER VIEW PHOTOGRAPHY cannot fulfill the agreement due to illness for example, a different time will be agreed with you free of charge. If, for example, due to a technical malfunction of the equipment, the appointment cannot go through, SHUTTER VIEW PHOTOGRAPHY will make another appointment with you free of charge and give you a 20% discount on this.

Model Release

The CLIENTS hereby grants to SHUTTER VIEW PHOTOGRAPHY and successors, heirs, executors, administrators, assigns, attorneys, representatives and agents, the irrevocable and unrestricted right to use and publish photographs of the CLIENTS or in which the CLIENTS may be included, for editorial, trade, advertising or any other purpose and in any manner or medium; to alter the same without restriction; and to copyright the same. The CLIENTS hereby release SHUTTER VIEW PHOTOGRAPHY and all associates representatives and assigns from any and all claims, actions, demands, suits, liabilities, damages, expenses, and obligations of any kind arising from, or related in any manner to SHUTTER VIEW PHOTOGRAPHY’S use of said images

Liability

Shutter View Photography is not liable for any damage that has arisen for the other party. Unless there is a case of gross negligence or intent on the part of the Photographer or persons engaged by them. The liability is in any case limited to the amount of the invoice amount, or if and insofar as there is insured damage up to the amount of the sum actually paid under the insurance. Shutter View Photography is not liable for colour deviations or photo prints for products that are not supplied by it. Shutter View Photography is not liable for delivering less or less good photos than normal due to unforeseen circumstances that fall outside the influence of the photographer. This includes things such as children who do not cooperate, instructions that are not followed, weather conditions, etc.
